CONTRACT OF SALE
DEFINITION AND SUBJECT MATTER OF THE CONTRACT
This contract ("Contract") is a distance contract pursuant to art. 45 and ss. of Legislative Decree no. 206 of 6 September 2005 ("Consumer Code") in the case of consumer customers pursuant to art. 3 of the Consumer Code or, otherwise, a sales contract pursuant to art. 1470 and ss. c.c.
The object of the Contract is the sale of movable property between Colleblu S.r.l. (hereinafter "Colleblu"), with registered office in Cologne (BS) Via Brescia 45/A Codice Fiscale - Iscrizione Registro Imprese di Brescia and Partita IVA: 01750160986, R.E.A. N.BS- 348325, Share capital I.V. € 20,800 and the customer (the "Customer"). The Agreement is concluded directly through the acceptance by Colleblu of an order issued by the Customer through the website www.colleblu.it.
PRICES
The prices of the products on the website www.colleblu.it are shown in Euro and include VAT and all other taxes. Transport costs are included in the sale price.
If an incorrect price has been advertised, Colleblu will contact the Customer to check if he still intends to proceed with the purchase of the product at the correct price. If the Customer does not intend to proceed with the purchase, or Colleblu fails to contact him, Colleblu will cancel the order. Colleblu is not obliged to sell the product at the wrong price, if the error is knowable by the customer according to ordinary diligence.
METHOD OF PURCHASE
Colleblu may, at its sole discretion and without liability to the Customer, refuse the order received from the Customer. If the Customer intends to purchase products no longer available, Colleblu will inform the Customer.
DELIVERY OF PRODUCTS
Colleblu delivers its products throughout the Italian territory. Products placed in a single order cannot be delivered to different addresses and paid for by different payment methods. Unless otherwise agreed, Colleblu delivers to the address provided by the Customer at the time of registration. In case of multiple orders placed on the same day, where possible Colleblu will deliver all available products ordered in a single shipment.
PAYMENT OF PRODUCTS
We offer you different payment methods to allow you to choose the one that best suits your needs.
Prepayment by Credit Card: you can pay in advance by credit card or Paypal.
Prepayment by bank transfer: you can pay in advance your order by bank transfer to Banca di Credito Cooperativo di Brescia Fil. Cologne (BS) Iban: IT24R0869254390008000810684 under the name of COLLEBLU SRL.
Cash payment on delivery by courier: if you prefer, you can choose to pay cash directly to our courier at the time of delivery. Payment on delivery includes an additional cash contribution of € 6.00. This type of payment can only be selected for order amounts less than €1,000.00.
Payment at collection in the store: if you choose to pick up your order directly in one of our stores, you can pay comfortably when you collect the goods, with cash (for orders less than € 1,000.00), credit card or ATM.
In no case is allowed payment by cheque.
GUARANTEES AND ASSISTANCE
Consumers pursuant to art. 3 of the Consumer Code are entitled to the legal guarantee of conformity provided by art. 128 and ss. of the Consumer Code on all products which show a lack of conformity existing at the time of purchase or which appear within two years of delivery of the product. In case of lack of conformity, the customer who has reported within two months from the discovery of the same, will be entitled, without incurring any expense, to repair or replacement of the defective product by Colleblu. Where it is not possible or is excessively burdensome to implement the above mentioned remedies, the Customer shall be entitled to the price reduction or the termination of the Contract, in accordance with art. 130 of the Consumer Code. In the event that the Customer finds a lack of conformity, must report the same to the e-mail address shop@colleblu.it
OBLIGATIONS OF THE CUSTOMER
The Customer declares and guarantees to be of legal age and that the data provided by the same for the execution of the Contract are correct and truthful.
RIGHT OF WITHDRAWAL BY THE CONSUMER
The Customer, if he is a consumer pursuant to art. 3 of the Consumer Code, has the right to withdraw from the Contract, without any penalty and without specifying the reason, within 14 days from the day on which the Customer or a third party designated by him, other than the carrier, acquires physical possession of the property. The Customer may exercise the right of withdrawal by contacting the Customer Service at the e-mail address shop@colleblu.it. The period within which the right of withdrawal may be exercised shall be deemed to be respected if the communication concerning the exercise of this right is sent before the expiry of the withdrawal period. The Customer has the right to withdraw from the Contract provided that the product is returned substantially intact, in its packaging and with labels and tags not removed. The Customer who intends to exercise the right of withdrawal must send the products without undue delay and in any case within 14 days from the day he communicated to Colleblu the decision to withdraw from the Contract at Colleblu S.r.l. Via Brescia 45/A 25033 Cologne (BS).
The return of the product through the exercise of the right of withdrawal in the manner described above involves the reimbursement of the price of the product purchased, while the direct costs of returning the product will be charged to the Customer. The refund will normally be made using the bank transfer method, for this purpose the customer will have to provide the data of its bank support.
GENERAL CLAUSES
Colleblu may assign to third parties all or part of the rights and obligations arising from this Agreement. Colleblu reserves the right to modify these Terms and Conditions without prior notice and without prejudice to any sales made prior to such changes. Any changes shall be effective from the date on which they are communicated to the public and shall apply to sales made from that date. The Customer’s personal data are processed by Colleblu S.r.l. as provided in the Data Processing Policy, available on the website www.colleblu.it, Privacy Section.
This Agreement is subject to Italian law. If the Customer is a consumer pursuant to art. 3 of the Consumer Code, the jurisdiction for the resolution of any disputes arising from the interpretation, execution and termination of the Contract is devolved to the judge of the place of residence or domicile of the consumer, if located in Italy. In addition, pursuant to Article 49, paragraph 1, letter V of the Consumer Code, the Consumer Customer may use the Joint Conciliation procedure. The procedure can be initiated if the Customer, after submitting a written complaint to Colleblu, within thirty days, has not received any reply or has received a response considered unsatisfactory.
